As experienced insurance brokers, we understand the role that good surveillance can play in a work comp claim — and that’s why we advocate for the selection of qualified surveillance contractors in order to help employers overcome the hurdles involved in accumulating admissible evidence to fight back against fraudulent claims. Unfortunately, surveillance is one of the most difficult and frustrating elements of potentially fraudulent workers comp cases, due largely to California legal precedents excusing injured employees for “good days” during which they may engage in activities inconsistent with their purported injuries. Therefore, it is critical for employers to take an active role in each and every claim, understand what the injury is, and gather as much information about the employee’s activities as possible in conjunction with well-coordinated activity.
